It is truly amazing the Equal Protection Clause was enacted into law in 1868 and gay people still can not get legally married. The 1st and 14th amendement protect us! They need to use a rational basis test similar to the one they did in Lawrence v Texas. If they do, they will realize that? if we can not marry the one we love then heterosexual couples should be forbidden to do so as well. Then, it would be a no-brainer to allow same-sex marriage due to the unconstitutionality of the ban.
